Terms of Use
Last updated October 26, 2026
These terms apply to anyone using Prospeek. By creating an account or using the platform, you agree to them on your own behalf and on behalf of the company you represent.
The service
Prospeek is a platform for businesses to run prospecting, customer service and sales: it connects messaging channels (WhatsApp, Instagram, email), organizes leads and deals, and can reply automatically with bots and AI agents configured by the company itself.
Account and access
The client company is responsible for the people it invites, the roles it grants them and the safekeeping of passwords. Tell us immediately about any unauthorized access.
Acceptable use
Using the platform for spam, scams, illegal content, harassment, or to contact people who asked not to be contacted is forbidden. Each channel has its own rules — the WhatsApp Business Policies, Meta Platform Terms and Instagram Community Guidelines — and the client company agrees to follow them. Accounts that break these rules may be suspended.
Data and content
Contacts’ data and conversations belong to the client company, which is the controller of that data and responsible for the legal basis to process it. Prospeek processes that data as a processor, as described in the Privacy Policy.
Third-party channels
WhatsApp, Instagram and other channels are third-party services that may change their rules, prices or availability without notice from us. Charges billed directly by Meta to the company (for example, official WhatsApp conversations) are between the company and Meta.
Artificial intelligence
AI-generated replies may contain mistakes. The client company configures what the agent may say and do and is responsible for how it uses it.
Payment and cancellation
Plans, credits and prices are those agreed at signup. The company may cancel at any time; access continues until the end of the period already paid.
Liability
The platform is provided as is. To the extent permitted by law, we are not liable for indirect losses or for failures of third-party services.
Governing law
These terms are governed by the laws of Brazil.
